TERMS OF SERVICE
CHIS-UK is an information centre on the subject of alternative and complementary
medicine. CHIS-UK also provides a web design service, web hosting services and
other Internet services via the site at www.besthost.co.uk.
CHIS-UK reserves the right to suspend or cancel a customer's access to any
or all services provided by CHIS-UK when CHIS-UK decides that the account has
been inappropriately used or otherwise.
SERVER USE (for services provided via besthost.co.uk)
Account holders are not permitted to resell, store or give away web-hosting
services of their website to other parties. Web hosting services are defined as
allowing a separate, third party to host content on the owner's web site. Exceptions
to this include ad banners, classified ads, and personal ads.
Customers may not resell our Internet services.
CHIS-UK reserves the right to refuse service and /or access to its servers
to anyone.
CHIS-UK do not allow any of the following content to be stored on its servers:
Illegal Material - This includes copyrighted works, commercial audio, video,
or music files, and any material in violation of any national or local regulation.
Adult Material - Includes all pornography, erotic images, or otherwise lewd
or obscene content. The designation of "adult material" is left entirely
to the discretion of CHIS-UK.
Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password
cracking. IP spoofing, etc., and encrypting of any of the above. Also includes
any sites which provide "links to" or "how to" information
about such material.

USE POLICY
CHIS-UK maintains a very large ratios of bandwidth per customer. In rare cases,
CHIS-UK may find a customer to be using server resources to such an extent that
he or she may jeopardise server performance and resources for other customers.
In such instances, CHIS-UK reserves the right to impose the High Resource User
Policy for the consideration of all customers.
HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilisation.
CHIS-UK may implement the following policy to its sole discretion:
When a website is found to be monopolising the resources available, CHIS-UK
reserves the right to suspend that site immediately. This policy is only implemented
in extreme circumstances and is intended to prevent the misuse of our servers.
PAYMENT POLICIES
All accounts are set up on a prepay basis. Although CHIS-UK reserves the right
to change prices of accounts or services at any time all pricing is guaranteed
for the period of prepayment. Payment is due each anniversary year or month following
the date the account was established. Customers will automatically be charged
again at the end of their prepay period unless closure notification has already
been given in writing (by letter or fax).
In situations where the card number on file is declined CHIS-UK will immediately
suspend the facility to purchase services on-line until the outstanding charge
is processed successfully. In addition, CHIS-UK reserves the right to suspend
other services until the outstanding debt is cleared. The customer is responsible
for all money owed on the account from the time it was established to the time
that the customer sends a written cancellation request.
All invoices will be sent directly to customers via email or standard post
shortly after the online purchase has been made. At this point the customer's
card will be charged automatically.
All prices shown are in UK sterling.
Domain names are registered for the period specified at the time of ordering,
and are renewable by Customer on or before the end of the initial paid-for period,
at the then current renewal rates
Website hosting period is 12 months, at the rate specified on this website.
Website hosting is automatically renewed and payable for 12 months on termination
of the initial contract period and any subsequently renewed contract period, unless
Customer gives one month written notice to CHISUK.net to cease the Service. A
reminder will be sent 60 days before the expiration period.
PAYMENT OPTIONS
All payments must be in UK Pounds Sterling. In order to streamline our accounting
procedures and keep costs down CHIS-UK runs a limited number of payment options.
Credit / Debit Cards:
CHIS-UK accepts MasterCard, Visa (not Visa electron) and Switch
Cheque Payment:
This option is only available to customers who pay annually for their CHIS-UK
account. A credit / debit card number will still be required if customers require
the facility to purchase domains and other services on-line. CHIS-UK cannot guarantee
that a service will be provided until after any received cheques have been cleared.
If your cheque is returned by the bank as unpaid for any reason, you will be
liable for a "returned cheque" charge of £25
CANCELLATION AND REFUNDS
Customers have a right to cancel an order within 7 days of us accepting payment.
In that case, a refund will be given within 30 days of receiving a cancellation
notice. A refund will not be made for domain names registration and hosting services
as it is agreed that the service is provided within 48 hours of the payment being
made.
Customers may also cancel their account at the end of a period of service,
at least 15 days before renewal is due to take place. Cancellation must be in
writing, either by email, fax or post. Any incentives offered to customers
when opening the account will also be cancelled. Customers may be given the option
to purchase services which were offered as start-up incentives in the result of
a cancellation.
CHIS-UK reserves the right to cancel the service at any time. In this event
customers will be entitled to a pro rata refund based upon the remaining period
of "membership". If a customer contravenes CHIS-UK's terms of service
a refund will not be issued in the event of a cancellation. Where it is found
that CHIS-UK is in breach of the terms & conditions, then a refund may be
due to the customer.
DELIVERY & PROVISION OF SERVICE
We shall use our reasonable endeavours to make available to you at all times
the server and the services but we shall not, in any event, be liable for interruptions
of service caused by server downtime, upgrades and maintenance work.
We aim to complete all orders within 48 hours of payment being received and
cleared through our bank, with the exception of web design where work will be
completed within a reasonable time.
COMPLAINTS
We endeavour to respond to all complaints within five working days. Complaints
should be made in writing either by email to admin@chisuk.org.uk or
by fax using number +44 (0)870 7621351.
INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold CHIS-UK harmless
from any and all demands, liabilities, losses, costs and claims, including reasonable
attorney's fees asserted against CHIS-UK, its agents, its customers, officers
and employees, that may arise or result from any service provided or performed
or agreed to be performed or any product sold by customer, its agents, employees
or assigns. Customer agrees to defend, indemnify and hold harmless CHIS-UK against
liabilities arising out of; (1) any injury to person or property caused by any
products sold or otherwise distributed in connection with CHIS-UK's server; (2)
any material supplied by customer infringing or allegedly infringing on the proprietary
rights of a third party; (3) copyright infringement and (4) any defective products
sold to customer from CHIS-UK's server.
DISCLAIMER
CHIS-UK will not be responsible for any damages your business may suffer. CHIS-UK
makes no warranties of any kind, expressed or implied for services we provide.
CHIS-UK disclaims any warranty or merchantability or fitness for a particular
purpose. This includes loss of data resulting from delays, non-deliveries, wrong
delivery, and any and all service interruptions caused by CHIS-UK and its employees.
CHIS-UK reserves the right to revise its policies at any time.
These terms and conditions do not affect your statutory rights as a consumer.
PRIVACY
We are committed to protecting your privacy. We will only use the information
that we collect about you lawfully (in accordance with the Data Protection Act
1998) and according to the Which? Web Trader Code of Practice.
We collect information about you for 2 reasons: firstly, to process your order
and second, to provide you with the best possible service.
We will not e-mail you in the future unless you have given us your consent.
We will give you the chance to refuse any marketing email from us or from another
trader in the future.
The type of information we will collect about you includes:
your name
address
phone number
email address
We will never collect sensitive information about you without your explicit
consent. The information we hold will be accurate and up to date. You can check
the information that we hold about you by emailing us. If you find any inaccuracies
we will delete or correct it promptly.
The personal information which we hold will be held securely in accordance
with our internal security policy and the law and the Which? Web Trader Code.
If we intend to transfer your information outside the EEA (European Economic
Area) we will always obtain your consent first.
We may use technology to track the patterns of behaviour of visitors to our
site. This can include using a "cookie" which would be stored on your
browser. You can usually modify your browser to prevent this happening. The information
collected in this way can be used to identify you unless you modify your browser
settings.
